When a woman wants to divorce her husband, should she file a petition?
If a woman wants divorce/separation from her spouse then a divorce petition has to file before the Family Court of competent jurisdiction not before the Police station. The police officer has no authority to dissolve marriage. But if there is a case of domestic violence, demand of dowry it is advisable to report it to the police, and he will register an First Information Report. Section 13 of the Hindu Marriage Act lays down the various grounds for divorce.
