A wife has filed a divorce petition in a court.?
This case was recently reported. It was from Maharashtra appealed before Hon'ble Apex Court. When divorce matter is pending disposal before the court, restitution of conjugal rights cannot be granted. In this particular case, wife had filed for divorce, but husband had filed for Restitution of conjugal rights. The appeal was upheld by the Apex Court for grant of divorce.
