If not, and its simply a custody issue, then a judge will collect whatever evidence is presented to him and determine which parent can best care for the child. The welfare and best interests of the child are the judges sole concern in a custody case. A questionable character isnt going to be enough to prevent someone from getting custody. There has to be EVIDENCE that the parent in question is not the best one to raise the child.
