Under Hindu Law a wife is entitled to maintenance and separate residence under Sec 18 of the Hindu Adoptions and Maintenance Act 1956, Sections 24,25, of Hindu Marriage Act 1955, and Sec 125 of CrPC 1973. Except under Sec13B of Hindu Marriage Act which allows divorces by mutual consent, divorces on various other grounds are generally considered as difficult task. Apart from this your wife can still claim on your family property. Marriage in Hindu law is a sacrament, not a contract. Unless there are serious reasons divorce is not to be sought upon.
