In this case the husband who doesnt live in India may not even contest the divorce petition and the Family Court can proceed ex-parte against the husband and allow divorce to the wife. The only lose the wife suffer is not getting the agreed financial compensation from the husband. However after obtaining the divorce order and decree, she can always seek order for permanent alimony and maintenance against the husband if shes interested for it otherwise she can move ahead in life with decree of divorce.
