Can we take a mutual divorce on the day of the filing of the petition?
Not possible in India under any divorce law, whether under the Hindu Marriage Act, 1955 or the Special Marriage Act, 1954 or the Divorce Act . The procedure for divorce by mutual consent takes at least two motions where the time period of six months exists between two motions or court proceedings. The six months period can be condoned or waived off by the Family Court but that too after one week of the first motion when both parties request for the waiver based on circumstances.
