If you have threat to life, lodge complaint to local police against the people who have threatened you. If you are living with them in their house, move out with your son under the protection of the local police after lodging criminal complaint against them. There is no direct petition under the fundamental rights to be filled in the court as the law enforcement agencies are their to help you and if they fail to help you then only move to the court for appropriate relief.
