How do I get alimony if my husband has filed for divorce under?
The wife who is unemployed and does not have sufficient means to maintain herself can seek the maintenance from the husband during the pendency of the divorce proceedings under section 24 of the Hindu Marriage Act,1955. The wife can even seek permanent alimony and maintenance under section 25 of the HMA at the finalisation of the divorce proceedings. The Family Court will decide these applications filled by the wife on the basis of financial conditions of both parties and requirements of the wife for her maintenance and financial support for living reasonable decent life that she was enjoying with her husband in their matrimonial home.
