Can women file a DV case and maintenance after her husband files a?
Yes she can file a DV and maintenance case anytime, even after her husband filed a divorce petition. The interim maintenance can be claimed by the wife even during pendency of divorce petition in the same divorce case or separate regular maintenance case under section 125 CrPC. The DV case too include relief for maintenance, place of residence and protection order from any domestic violence inflicted by the husband on the wife. The claim of maintenance made by the wife will depend on the financial status of both the parties and their individual income.
